Use of the site by minors

If you are under 18, you may register and use the Website with the involvement of a parent or guardian. Please do not attempt to register on the Website if you are under the age of 18. Registration of a minor is permitted with a parent or guardian. Minors who are at least 12 years of age and meet the minimum height requirement of 4’11” may register for spin classes. Other classes such as yoga or dance that do not use heavy equipment do not have height requirements but need to be cleared with the studio in advance.
Reservations/Charges/Cancellations

Reservations for Classes

In order to make a reservation, you must first buy a single class or a series of classes. Classes do expire. The expiration dates are posted in the description of the class or series of classes. If, however, you cannot book a ride/class on the website, email us at contact@thecyclingpigeon.com or stop by the studio and we can help you.

Payment

We accept MasterCard, Visa, Discover, and American Express. Cash payments may only be made in the studio.

Cancellations for Classes

In order to cancel a reservation for a class and return it to your account, you must unreserve by 5 PM the night prior to the class. Once your reservation is cancelled, the class will be returned to your account to be used at a future date; the class is not refunded. If you haven’t cancelled by 5 PM the night before, your scheduled class will be charged to your series or a late cancellation fee of $10 will be charged to your card on file.

In fairness to all our customers, BIKES AND SPOTS WILL BE RELEASED 4 MINUTES BEFORE CLASS BEGINS. In the event that you do not unreserve your bike by 5 PM the night prior to class, or if you do not claim your bike at least 4 minutes before class begins, the studio shall have the right, without any credit or refund to you, to allow others to reserve or use your bike for a fee.

Please note that if you are running late, we ask that you text the studio to let us know you are on the way. If you text the front desk at least 4 minutes before class begins, we will hold a reservation until class begins, though we cannot guarantee you will be given the bike you signed up for in the particular class.

Cancellation Policy for Memberships

We require a one month notice by email or text for cancelling memberships or pausing memberships. Note that members may pause memberships for work, family or travel issues for only one month without being charged. Paused memberships will automatically resume the following month. Members may use a “pause” only once per year.

The Cycling Pigeon Assumption of Risk, Waiver, and Release

By participating in and/or attending classes, events, activities and other programs and/or by using the premises, facilities, equipment (individually and or collectively the “Classes and Facilities”) of The Cycling Pigeon you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in indoor cycling and exercise equipment in association with the Classes and Facilities, and that you participate in and/or use the Classes and Facilities entirely at your own risk.

You acknowledge and agree that some of these risks cannot be eliminated, regardless of the care taken to avoid injury. While specific risks vary depending on activity, risks may range from minor injuries, such as scratches, bruises and sprains, to major injuries such as loss of sight, joint or back injuries, heart attacks, seizures, and concussions, or catastrophic injuries including but not limited to paralysis and death. We urge you to obtain a physical examination from a doctor before participating in any activity or using any equipment or the facility of The Cycling Pigeon.

You acknowledge that if you have any chronic disabilities or conditions, you are at risk in using the The Cycling Pigeon Classes and Facilities, and you should not utilize the Classes or Facilities without specific approval by your doctor. At all times, you agree to comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by The Cycling Pigeon staff or instructors.

In consideration of your participation in and/or use of the Classes and Facilities, you hereby (1) agree to assume full responsibility for any and all injuries or damages which are sustained or aggravated by you in relation to the Classes and Facilities; (2) you release, indemnify and hold harmless TCP, its owners, officers, directors, members, employees, agents, instructors, successors and/or assigns (collectively “TCP”), and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities (including but not limited to negligence) to the fullest extent allowed by law arising out of or in any way relating to your participation in and/or use of the Classes and Facilities; and (3) represent and warrant that you do not have a physical or mental condition that would prevent you from safely participating in or using the Classes and Facilities or put you in any physical or medical danger, and you have not been instructed by a physician not to participate in physical exercise.

IMPORTANT NOTICE REGARDING COVID-19: You acknowledge that you have had an opportunity to review all state, local, and federal information and warnings provided to the public by various government agencies regarding COVID-19, which has been declared a worldwide pandemic by the World Health Organization (“WHO”), including the guidelines, safety precautions, suggested preventive measures, social distancing, and sanitization recommendations, and the required restrictions and health dangers regarding the public emergency related to COVID-19/coronavirus, including the high risk of contagion including from person-to-person contact. By signing below, and participating at TCP in exercise, classes, and/or training you accept and acknowledge any risk that your participation in TCP training and/or instruction may present related to COVID-19, and agree to release, indemnify, and forever hold harmless TCP and all trainers, instructors, contractors, owners, agents, and employees, and any of their representatives, agents, or contractors, from any and all damage or liability arising from or relating to COVID-19/coronavirus. TCP cannot guarantee that you will not become exposed, infected, or otherwise contract COVID-19 while attending, participating in, or otherwise engaging in any activities at or in connection with TCP, and you expressly assume any and all risk related to COVID-19.

I have read this Assumption of Risk, Waiver, and Release Agreement, fully understand its terms, and understand that I am giving up substantial rights including my right to sue The Cycling Pigeon under certain circumstances. I acknowledge that I am signing this waiver freely and voluntarily. The term of this waiver is indefinite.

With regard to valuables and personal property, you acknowledge that you have been urged to avoid bringing valuables into the TCP facilities, and TCP shall not be liable for loss, theft or damage to your personal property. You acknowledge that no portion of any fees paid by you is in consideration for safeguarding your valuables.
